INTRASTATE ACCESS CHARGE PROCEEDINGS

The Michigan PSC opened Case U-16943 to seek comments on the FCC 11-161 order and to determine what if any impact the order would have on updated Michigan Telecommunications Act (MTA). The MTA requires a reduction of intrastate terminating and originating access rates to not exceed the interstate rates by annual reductions of at least 20% beginning January 1, 2012, with parity to be achieved no later than January 1, 2015. The FCC order deals only with terminating rates and requires parity to be achieved by July 1, 2013 with a 50% reduction by July 1, 2012.

The PSC determined that there is no preemption of the originating access rate reduction by the FCC order, and that the reduction of terminating rates is also not preempted since the FCC order allows for faster reductions of intrastate rates if allowed by the PSC. Therefore, the PSC has ordered that any carrier that has not filed revised tariffs for the January 1, 2012 required reduction of intrastate access rates must file their reductions no later than 15 days after the date of this order.
