The Colorado Department of Regulatory Agencies (DORA) has issued an order for Docket 12R-862T regarding changes to its rules to allow for competitive telecommunications regulations within the state of Colorado. Beginning in 2013 the PUC will initiate a review to determine where effective competition exists within the state for basic telecommunications services. Where effective competition is determined to exist, then basic telecommunications services, with the exception of switched access or emergency services will be regulated under Part III rules, meaning that the carrier are not required to follow the commission tariffing rules.
IP enabled services and VoIP providers are determined to be deregulated except for emergency services. In addition, IP enabled services and VoIP providers must pay into the 911, Low Income Telephone Assistance Program, Telephone Relay Service, HCSM and Fixed Utility Fund programs.
The PUC has also adopted an annual cap of $54M for the HCSM fund. Finally, caps have been placed upon the switched access charges by rate element for all ILECs and CLECs as of their January 1, 2012 rates.
